Effective date: October 17, 2026
These Terms of Use ("Terms") are a legal agreement between you and Jose Alexi Torres, an individual in New Jersey doing business as GasApp ("GasApp," "we," "us," or "our"). They cover the GasApp mobile app for iPhone and Android, its features and subscriptions, and any related services, websites and communications (together, the "Service").
Please read these Terms carefully. They include a binding arbitration agreement and class action waiver (Section 20) that affect how disputes are resolved, and important limits on our responsibility for your vehicle, devices and driving (Sections 6, 7, 16 and 17).
By tapping "Agree and continue" in the app, or by downloading, opening or using the Service, you agree to these Terms and to our Privacy Policy (getgasapp.com/pages/app-privacy), which is part of these Terms. If you don't agree, don't use the Service.
1. Who can use GasApp
You must be at least 18 years old, or the age of legal majority where you live, to accept these Terms and to buy a subscription. If you're between 13 and that age, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms for you. The Service isn't for children under 13.
You must also hold any driver's license your area requires to drive the vehicle you use with the Service, and you may only connect GasApp to a vehicle you own or have permission to use.
2. What GasApp does
GasApp estimates and displays what your driving costs in fuel. Depending on how you use it, it may:
- estimate fuel use from your phone's GPS (speed and acceleration) and your car's published fuel economy;
- read data from your vehicle's on-board diagnostics port ("OBD-II") through a compatible Bluetooth reader, such as fuel rate, airflow, speed, engine temperature, battery voltage and diagnostic trouble codes;
- show trip, daily, weekly, monthly and yearly costs, make PDF reports, and give tips and alerts about fuel use, driving habits and vehicle readings;
- look up gas prices, vehicle details and fuel economy from public sources.
Everything GasApp shows is an estimate. Fuel use, cost, mileage, prices, alerts, trouble-code descriptions and tips can be wrong or incomplete. They are for general information only and are not professional, mechanical, financial, tax, legal or safety advice.
3. Your account and devices
GasApp doesn't require an account today. You're responsible for your phone, its security, its settings (including location, Bluetooth and notifications), your internet and mobile data, and any charges from your carrier. If we add accounts later, you'll be responsible for keeping your sign-in details safe and for everything done with your account.
4. Safe and lawful use
Never use GasApp in a way that distracts you from driving. Set it up, enter prices and change settings only while parked. Don't look at or touch your phone while driving except as the law allows, such as hands-free in a mounted phone. Always obey traffic laws, drive according to road and weather conditions, and keep your attention on the road.
GasApp's alerts (for example about engine temperature, the battery, low fuel or trouble codes) are a convenience, not a safety system. They may be late, missing or wrong. Always rely on your vehicle's own gauges, warning lights and manuals, and on a qualified mechanic. If your vehicle shows signs of a problem, stop safely and get help whatever GasApp shows.
You're solely responsible for how you drive, for decisions you make based on the Service, and for complying with all laws that apply to you.
5. OBD readers and your vehicle
Some features use a Bluetooth OBD-II reader plugged into your vehicle's diagnostic port. Whether you buy the reader from us, from getgasapp.com, or from anyone else, you understand and agree that:
- You install, use and remove the reader at your own risk. Follow the reader's instructions and your vehicle manufacturer's guidance.
- Not every vehicle, reader or phone works with GasApp, and some vehicles report only some data. Compatibility lists are a guide, not a promise.
- A reader can drain your battery. Many readers stay powered while plugged in, even with the engine off. If you won't drive for a while, or your battery is weak, unplug the reader. A drained battery can leave you unable to start your vehicle.
- A reader can interfere with your vehicle. Devices on the diagnostic port can, in rare cases, cause warning lights, error codes, electrical issues, communication problems between your vehicle's computers, or unexpected behavior. If you notice anything unusual, unplug the reader and have the vehicle checked.
- Clearing trouble codes doesn't fix anything. It turns off the check engine light and resets your vehicle's emissions self-tests ("readiness monitors"), which can cause your vehicle to fail an inspection until it's been driven enough to complete them. It can also erase information a mechanic would use. Clear codes only when parked, and only if you understand the consequences.
- The reader may physically obstruct or wear the port, and a loose reader can fall into pedal areas. Make sure it's fully seated and doesn't interfere with driving.
- Warranties and leases. Adding devices or clearing codes may affect your vehicle's warranty, lease or service terms. Check with your manufacturer, dealer or lessor if unsure.
- Readers bought on getgasapp.com are also covered by that store's terms, shipping and refund policies, and any warranty from the manufacturer. These Terms don't add a warranty to any reader.
To the fullest extent the law allows, GasApp is not responsible for any damage to, malfunction of, or loss of use of your vehicle, its battery, its electrical or computer systems, its diagnostic port, or anything else, caused by or connected with a reader, its connection to your vehicle, clearing codes, or your use of the Service (see also Sections 16 and 17).
6. Fuel, cost and price information
Fuel use and cost estimates depend on your vehicle, your reader, your phone's sensors, GPS accuracy, the price you enter or that we look up, and many other factors. Gas prices from public sources may be out of date or different from what you pay. Don't rely on GasApp for anything where accuracy matters, such as tax returns, expense claims, business records, insurance or legal matters, without checking against your own receipts and records. PDF reports are provided as is.
7. Trouble codes and vehicle health
Descriptions of trouble codes, urgency ratings ("pull over," "get it checked soon," "not urgent"), "Keep driving?" answers, readiness information, and alerts are general information drawn from public standards. They may not match your vehicle, and they can't diagnose it. They are not a substitute for an inspection by a qualified mechanic. Some codes and modules (such as airbag, brake or body systems) can't be read or cleared by a generic reader.
8. GasApp Pro subscriptions
Some features ("GasApp Pro") need a paid subscription. Plans, prices and what's included are shown in the app before you buy. Prices may vary by country and include or exclude taxes depending on your store.
- Billing through Apple or Google. Subscriptions are sold and billed by the Apple App Store or Google Play ("App Store"), under their terms. We don't see or store your payment card details.
- Free trials. A free trial, if offered, is for new subscribers only and is limited to one per person or account as the App Store decides. Unless you cancel at least 24 hours before the trial ends, the subscription starts and you're charged automatically.
- Automatic renewal. Subscriptions renew automatically for the same period at the then-current price until you cancel. Your App Store charges your account within 24 hours before each period ends.
- Canceling. Cancel anytime in your App Store account settings (on iPhone: Settings › your name › Subscriptions; on Android: Google Play › Payments & subscriptions). Deleting the app doesn't cancel a subscription. After canceling, Pro stays on until the end of the period you paid for.
- Refunds. Payments are non-refundable except as required by law or by your App Store's refund policy. Refund requests go to Apple or Google, not to us.
- Price changes. We may change prices. Your App Store will tell you in advance as its rules require, and may ask you to agree to an increase.
- Changes to features. We may add, change or remove Pro features. If we remove a major feature you paid for, you may cancel.
- Offer codes and free periods. Codes for free or discounted periods, such as the free year that comes with a reader from getgasapp.com, are issued by the App Store. They must be redeemed with the App Store, can be used once, may expire, have no cash value, can't be resold or transferred, and are subject to the App Store's rules. A free year included with a reader is canceled if its order is refunded or canceled before the code is claimed. When a free period ends, the subscription renews at the regular price unless you cancel. Codes for Android may be offered later or give a different free period because of Google Play limits.
9. Your data and privacy
Our Privacy Policy explains what information we collect, how we use it, how we share and may sell it, and the choices and rights you have. By accepting these Terms you also accept the Privacy Policy, including that we may collect, store, analyze and upload information about your trips, driving, vehicle and use of the Service to our servers, use it to provide and improve the Service and for research and development, and share or sell it to third parties, as described there and subject to the rights the law gives you (such as the right to opt out of the sale of your personal information, which no agreement takes away).
10. Your content and feedback
You keep ownership of information you enter, such as labels and notes, and give us a worldwide, royalty-free license to store, process and use it to run the Service and as our Privacy Policy describes. If you send us ideas, suggestions or feedback, we may use them for any purpose without paying you or owing you anything.
11. Our license to you
Subject to these Terms, we give you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to download and use the app on devices you own or control, for your personal, non-commercial use. If you use GasApp for work, such as tracking work trips, you may do so for your own records.
12. What you may not do
You agree not to, and not to help anyone else to:
- copy, modify, distribute, sell, rent, lend or sublicense the app;
- reverse engineer, decompile or try to extract its source code, except where the law expressly allows it;
- get around subscription checks, offer-code limits, security or other protections, or use unauthorized codes;
- resell or trade codes, or buy readers just to resell their free periods;
- interfere with or overload the Service or its servers, or access them with bots, scrapers or other automated means;
- use the Service unlawfully, to harm others, or to collect information about other people;
- connect GasApp to a vehicle without the owner's permission, or use it to track another person;
- remove copyright, trademark or other notices.
13. Ownership
The Service, including its software, design, text, graphics, logos and the GasApp name, belongs to us and our licensors and is protected by law. Except for the license in Section 11, these Terms give you no rights in it.
14. Third-party services
The Service uses or links to services we don't control, including Apple, Google, the U.S. Energy Information Administration, fueleconomy.gov, the National Highway Traffic Safety Administration, Shopify, Cloudflare, Neon, Resend, your phone's location and Bluetooth services, and the reader's maker. Their terms and privacy policies apply to your use of them. We're not responsible for their content, accuracy, availability or actions.
15. Changes, availability and ending
We may change, suspend or discontinue all or part of the Service at any time, with or without notice, and may limit features by region or device. We may suspend or end your access if you break these Terms or if we're required to by law. You may stop using the Service at any time. Sections that by their nature should survive ending (including 5, 9, 10, 13, 16–22) do.
We may update these Terms. If we make material changes, we'll let you know, for example in the app, and may ask you to accept the new Terms before you continue. Continuing to use the Service after changes take effect means you accept them.
16. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL INFORMATION IN IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and those arising from course of dealing or usage. We don't warrant that the Service will be accurate, reliable, uninterrupted, secure or error-free, that it will work with your vehicle, reader or phone, that alerts will be given or be correct, or that any problem will be detected. Some places don't allow disclaiming implied warranties, so some of this may not apply to you.
17. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- GasApp, its owner, and our employees, contractors, agents, suppliers and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, use or goodwill, arising out of or relating to the Service or these Terms, however caused and on any theory of liability, even if we were told such damages were possible.
- We will not be liable for damage to, malfunction of, repair of, towing of, or loss of use of any vehicle or its parts, battery, electrical or computer systems or diagnostic port; for accidents, injuries, traffic or parking violations, fines, failed inspections or emissions tests, voided warranties, fuel costs, or decisions based on the Service; whether caused by the app, a reader, clearing codes, an alert or a missing alert, or any other use of the Service.
- Our total liability for all claims relating to the Service or these Terms won't exceed the greater of (a) the amount you paid us or the App Store for the Service in the 12 months before the event giving rise to the claim, or (b) fifty U.S. dollars (US $50).
- These limits apply even if a remedy fails of its essential purpose, and they are an essential part of the bargain between you and us.
Nothing in these Terms limits liability that can't be limited by law, such as for fraud, or for death or personal injury caused by our gross negligence or willful misconduct where the law doesn't allow it to be limited.
18. Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless GasApp, its owner, and our employees, contractors and agents from any claims, losses, damages, liabilities, costs and expenses (including reasonable attorneys' fees) arising from your use of the Service, your driving, your vehicle, a reader you use, your breach of these Terms, or your violation of any law or the rights of anyone else.
19. Governing law
These Terms and any dispute relating to them or the Service are governed by the laws of the State of New Jersey and applicable U.S. federal law, including the Federal Arbitration Act, without regard to conflict-of-law rules. Subject to Section 20, any claim not subject to arbitration must be brought only in the state or federal courts located in New Jersey, and you and we consent to their jurisdiction.
20. Arbitration agreement and class action waiver
Please read this section carefully. It affects your rights, including your right to go to court.
- Try us first. Before filing a claim, you agree to email support@getgasapp.com with your name, contact details, a description of the dispute and the relief you want, and to try to resolve it informally for 60 days. We'll do the same for claims we have against you.
- Binding individual arbitration. If it isn't resolved, you and we agree that any dispute, claim or controversy arising out of or relating to these Terms, the Service, a reader used with it, or our privacy practices (including whether this arbitration agreement applies or is enforceable) will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, before one arbitrator. The arbitration may be held by video, phone, written submissions, or in the county where you live.
- You are giving up your right to go to court. By agreeing to arbitration, you and we each waive the right to sue in court and to have a trial before a judge or a jury. The arbitrator decides the dispute instead, and court review of an arbitration award is very limited.
- No class actions. You and we may bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective, consolidated or representative action or arbitration. The arbitrator can't combine more than one person's claims or award relief to anyone but the individual party.
- Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and may ask a court for an injunction to stop infringement or misuse of intellectual property.
- Costs. Fees are paid as the AAA Consumer Arbitration Rules provide. If your claim is for $10,000 or less and isn't frivolous, we'll pay your share of the AAA's filing, administration and arbitrator fees.
- 30-day opt-out. You can reject this arbitration agreement by emailing support@getgasapp.com, with the subject "Arbitration Opt-Out," within 30 days after you first accept these Terms, including your name and the email or other details we can use to identify you. Opting out doesn't affect anything else in these Terms.
- If part of this section is invalid. If the class action waiver is found unenforceable for a claim, that claim (and only that claim) will be heard in court, not arbitration. If any other part of this section is unenforceable, the rest still applies.
- Changes. If we change this section, the change won't apply to disputes we already knew about, and you may reject it within 30 days by emailing us as in item 7.
21. New Jersey residents
If you live in New Jersey, nothing in these Terms limits any rights you have under the New Jersey Consumer Fraud Act or the Truth-in-Consumer Contract, Warranty and Notice Act. Specifically, to the extent New Jersey law doesn't allow them, the following don't apply to you: the exclusion of punitive damages in Section 17.1; the limits in Section 17 on liability for our own negligence, gross negligence or willful misconduct; the dollar cap in Section 17.3 for harm caused by our negligence; and the requirement in Section 18 to indemnify us for our own negligence. All other provisions apply.
22. Apple and Google
If you got the app from the Apple App Store: These Terms are between you and us only, not Apple, and we (not Apple) are solely responsible for the app and its content. Your license is limited to using the app on Apple-branded products you own or control, as the App Store's Usage Rules permit (including Family Sharing where enabled). Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent the law allows, Apple has no other warranty obligation for the app. We, not Apple, are responsible for any product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection and privacy claims, and claims that the app infringes someone's intellectual property, to the extent required by these Terms. You confirm that you're not in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you're not on any U.S. Government list of prohibited or restricted parties. You must follow any third-party terms that apply when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms, and on your acceptance Apple has the right to enforce them against you. Questions, complaints or claims about the app go to us at the contact details below.
If you got the app from Google Play: Google Play's Terms of Service also apply, and Google is not responsible for the app.
23. General
These Terms (with the Privacy Policy and any terms shown at purchase) are the entire agreement between you and us about the Service and replace any earlier agreements. If any provision is unenforceable, it will be enforced as far as possible and the rest stays in effect. Our not enforcing a provision isn't a waiver. You may not assign these Terms without our written consent; we may assign them, including to a company we form or control to run GasApp, or in connection with a merger, acquisition, sale of assets or by law. If we assign them to such a company, it takes our place under these Terms, and we'll let you know in the app. We're not liable for delays or failures caused by events beyond our reasonable control. You agree to receive communications from us electronically, and that electronic notices and agreements satisfy any requirement that they be in writing. Headings are for convenience only, and "including" means "including without limitation."
